About these Terms
These Terms of Service apply to your use of the SAYORY website and to purchases made through our online store.
SAYORY is a trade name operated by Liubo, registered in the Netherlands. References to "SAYORY", "we", "us" or "our" refer to Liubo trading as SAYORY.
By placing an order, you confirm that you have read and accepted these Terms of Service. Our Privacy Policy, Returns and Refund Policy, and Shipping and Delivery Policy also apply where relevant.
Nothing in these Terms limits or excludes any mandatory rights you have under applicable consumer law.
Eligibility and customer information
To place an order, you must be at least 18 years old or otherwise legally capable of entering into a binding agreement. If you are under 18, an order may be placed only with the involvement and consent of a parent or legal guardian.
You must provide accurate, complete and current contact, billing and delivery information. You are responsible for reviewing this information before submitting your order and for informing us promptly if you discover an error.
You are responsible for maintaining the security of access to your customer account and email address.
Products and product information
We aim to describe and display our products as accurately as reasonably possible. Colours and appearance may vary slightly depending on your screen, device settings, lighting and product batch.
Product characteristics, ingredients, directions for use, suitability and certifications may vary by product. Please review the individual product page and the information provided on the product packaging before use.
Product information provided on our website is for general informational purposes and is not intended as medical advice or as a substitute for advice from a qualified healthcare professional.
Products must be used in accordance with the instructions and warnings provided on their packaging. If you have a medical condition, known allergy or specific concern about using a product, seek appropriate professional advice before use.
We may update product descriptions or discontinue products. Changes will not affect an order that we have already accepted, unless a change is required by law or necessary for product safety.
Orders and formation of the contract
When you submit an order, you make an offer to purchase the products in your cart.
After receiving your order, we will send an electronic confirmation to the email address you provided. The purchase agreement is concluded when we confirm acceptance of your order.
We may decline or cancel an order when: a product is unavailable; payment cannot be authorised or processed; the billing or delivery information is incomplete or appears incorrect; we reasonably suspect fraud, misuse or unauthorised activity; an obvious pricing or product-information error has occurred; or we are unable to fulfil the order due to circumstances outside our reasonable control.
If we cancel an order after payment has been received, we will refund the relevant amount using the original payment method.
Prices and payment
All prices displayed to consumers include applicable VAT unless expressly stated otherwise.
Delivery charges and any other applicable costs are displayed before you submit your order. The final total is shown during checkout.
Available payment methods are displayed at checkout. Payment is processed securely through Shopify Payments or another payment provider shown during checkout. We do not directly store complete payment-card details.
Promotions and discount codes may be subject to separate conditions. Unless expressly stated otherwise, discount codes cannot be combined, exchanged for cash or applied retrospectively.
Cancellation and right of withdrawal
You may submit a cancellation request for products that have not yet been fulfilled through the Orders and Returns section of our website (https://account.sayory.com/orders). A cancellation request does not automatically cancel the order. We will review the request and confirm whether the order can still be cancelled.
Your statutory right to withdraw from an online purchase remains unaffected. Information about the 14-day withdrawal period, return conditions, return costs, exclusions and refunds is provided in our Returns and Refund Policy (/policies/refund-policy).
Shipping and delivery
We currently deliver to the Netherlands, Belgium and Germany.
Orders are processed and delivered according to the estimated timeframes stated in our Shipping and Delivery Policy (/policies/shipping-policy). Delivery times are estimates and may be affected by public holidays, carrier delays or circumstances outside our reasonable control.
SAYORY remains responsible for the products until you, or a third party designated by you other than the carrier, receives them.
Please provide a complete and accurate delivery address. If you notice an error, contact us as soon as possible. We cannot guarantee that an address can be changed after an order has entered processing.
If delivery cannot be completed because the address supplied was incorrect or incomplete, reasonable additional delivery costs may be charged where permitted by law.
If we fail to deliver within the agreed period, you retain all rights available to you under applicable consumer law.
Product conformity and legal guarantee
Products must conform to the purchase agreement and possess the quality, functionality and characteristics that you may reasonably expect.
If a product is incorrect, damaged, defective or otherwise does not conform to the purchase agreement, please contact us at support@sayory.com with your order number and a clear description of the issue.
Your statutory rights concerning defective or non-conforming products are not limited by our Returns and Refund Policy or by these Terms.
Customer accounts and electronic withdrawal requests
Customer accounts allow you to view and manage eligible orders and submit return or cancellation requests.
Access is provided through the email address associated with your order and a verification code sent to that address. You are responsible for ensuring that your email account remains secure.
Submitting a request through your account does not guarantee approval where a product or request does not meet the applicable conditions. This does not affect any mandatory statutory right of withdrawal or other consumer right.
Intellectual property
The content of our website, including the SAYORY name, logos, visual identity, text, graphics, photographs, videos and website design, is owned by or licensed to SAYORY and is protected by applicable intellectual-property laws.
You may use the website and its content for personal and non-commercial purposes only. You may not reproduce, modify, distribute, publish, sell or commercially exploit our content without prior written permission, except where permitted by law.
Third-party names, trademarks and content remain the property of their respective owners.
Reviews and submitted content
If you submit a product review, image, comment or other content, you confirm that: you have the right to submit it; it is accurate and based on a genuine experience; it does not infringe the rights of another person; it is not unlawful, misleading, offensive or discriminatory; and it does not contain malicious software, advertising or spam.
You grant SAYORY a non-exclusive, worldwide and royalty-free right to display, reproduce and use the submitted content for operating and promoting our store, subject to applicable privacy and consumer-protection law.
We may remove content that violates these Terms or applicable law. We will not alter or suppress genuine reviews merely because they are negative.
Any compensation or incentive connected to a review must be clearly disclosed.
Third-party services and links
Our store is hosted by Shopify. Shopify and other service providers may provide payment, account, fulfilment, delivery, analytics or technical services needed to operate the store.
Purchases made through our store are agreements between you and SAYORY, not between you and Shopify.
Our website may contain links to third-party websites. We are not responsible for the content, availability or privacy practices of websites that we do not control. Before using a third-party service, you should review its applicable terms and privacy information.
Privacy
We process personal data in accordance with our Privacy Policy (/policies/privacy-policy) and applicable data-protection law.
Information may be processed by Shopify and other service providers where necessary to operate the website, process payments, fulfil orders, deliver products, prevent fraud or provide customer support.
Acceptable use
You may not use our website: for unlawful or fraudulent activity; to infringe intellectual-property, privacy or other legal rights; to transmit malicious code or interfere with website security; to obtain unauthorised access to accounts, systems or data; to collect personal data without a lawful basis; to send spam or misleading communications; or to disrupt or misuse the website or its services.
We may restrict access where reasonably necessary to protect customers, SAYORY, our service providers or the security of the website.
Availability, errors and interruptions
We aim to keep the website and its information accurate and available. However, temporary interruptions, technical errors or maintenance may occur.
We may correct typographical errors, inaccuracies or omissions. If an error affects an order you have already placed, we will contact you and handle the matter in accordance with applicable law.
Liability
SAYORY is responsible for loss or damage where liability follows from applicable law.
Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or intentional misconduct; product liability where it cannot legally be excluded; failure to provide products that conform to the purchase agreement; or any mandatory consumer right that cannot legally be limited.
We are not responsible for indirect business losses suffered by a consumer where such losses were not reasonably foreseeable and are unrelated to the personal or household purpose of the purchase.
Circumstances outside our control
We are not responsible for delays or failure caused by circumstances outside our reasonable control, such as severe weather, transport disruption, strikes, government measures, natural disasters, widespread technical failures or similar events.
We will take reasonable steps to reduce the effect of such circumstances and will inform affected customers where appropriate. Your mandatory rights concerning delayed or failed delivery remain unaffected.
Changes to these Terms
We may update these Terms to reflect changes to our services, business practices or legal obligations.
The version applicable to your purchase is the version available when you place the order. Changes will not apply retrospectively to an existing purchase unless required by law.
The current version and its last-updated date will remain available on this page.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will apply only to the extent permitted by law.
Governing law and disputes
These Terms and purchases made through our store are governed by Dutch law.
If you are a consumer living in another country, this choice of law does not deprive you of mandatory consumer protections provided by the law of your country of residence.
Disputes will be submitted to a court with jurisdiction under applicable law. Before commencing formal proceedings, we encourage you to contact us (https://sayory.com/pages/contact) so that we can try to resolve the matter directly.
